Existing incentives and advantages

With the purpose of promoting participation of the non-governmental sector in investment, Ministry of Energy has decided to implement and operate state water sector plans and projects particularly for generation and transmission of wastewater using it as a new water as well as development and improvement of primary and secondary irrigation and drainage networks of the country.  It is worth mentioning that investment of the non-governmental investors in the water sector shall take place based on provisions of Article 7 of the law for implementation of policies of Article 44 of the Islamic Republic of Iran’s constitution and articles 142, 194 and 214 of the Fifth Iranian Five Year Development Plan Act as well as subsection 2 of para. E of Note 11 of the Iranian Budget Law for 2014-2015, individually or jointly through cooperation between the non-governmental sector and the governmental one in form of free sale or guaranteed sale of the output to the government. The relevant procedures presently is under consideration through concerned authorities and departments.

The most important existing incentives in the water sectors are as follows:

Guaranteed purchase of water generated (by the private investor) by the Ministry of Energy (Article 142 of the Fifth Five Year Development Plan Act)

•Concluding guaranteed water purchase contract with the non-governmental sector for implementation of water and wastewater projects, containment of cross-border waters, water demand management, drainage of agricultural lands in contract forms of buy-back, BOT and other similar forms up to maximum of 10 Billion US Dollars or its equal in Rial (subsection 2 of para. E of Note 11 of the Iranian Budget Law for 2014-2015). 

Ceding national and dead lands that can be used as river basin of the relevant installations to the investor; after start of the operation these lands will be transferred to the investor by the Ministry of Agricultural Jihad (as stipulated in the Article 3 of the foreign investment promotion and protection Act 2002 concerning the water sector)

• Giving ownership of lands used as construction site and for implementation of the relevant project to the investors; the lands will be provided by Ministry of Agricultural jihad and Ministry of Energy (as stipulated in the article 5 of the foreign investment promotion and protection Act 2002 concerning the water sector)

Issuance of water document for the surplus water beyond the water right by Water and  Abfa Department of the Ministry of Energy in favor of the investors from the non-governmental sector (as stipulated in the article 2 of the  foreign investment promotion and protection Act 2002 concerning water sector)
